OnTheDaily
Terms of Use
Effective September 12, 2026. These terms are an agreement between you and BrickByte Labs LLC.
By downloading or using OnTheDaily, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the app.
1. The app
OnTheDaily is an iPhone journaling app. You get one local notebook at no charge. Notes are stored on your device. Optional cloud sign-in, extra notebooks, and sync require an active OnTheDaily Plus subscription.
We grant you a personal, non-exclusive, non-transferable license to use OnTheDaily on Apple devices you own or control, as permitted by the App Store terms.
2. Your content
You own the notes, todos, and other content you create. You are responsible for that content and for backing up anything you care about. Local-first storage means a lost, reset, or uninstalled iPhone can mean lost notes unless you synced a notebook to the cloud or exported it.
If you use cloud sync, you give BrickByte a limited license to host and transmit that content only as needed to provide the service you requested (for example, storing a notebook in Firebase and sending it back to your signed-in app).
3. Accounts
Cloud accounts use email and password. You must provide accurate information, keep the password confidential, and be of age to form a contract where you live (or use the app only with a parent or guardian’s permission).
You may delete your cloud account by emailing help@brickbytelabsllc.com or, when signed in, from OnTheDaily Settings. Deleting the cloud account removes the remote account and synced copies. It does not erase notes that remain only on your device, and it does not cancel Plus.
4. OnTheDaily Plus
Plus is an auto-renewable subscription purchased through Apple. Payment is charged to your Apple ID at confirmation. The subscription renews unless you cancel at least 24 hours before the end of the current period. Manage or cancel in Apple’s subscription settings. Unused portions of a free trial, if any, are forfeited when you buy Plus.
Apple’s Licensed Application End User License Agreement applies to the paid application in addition to these terms. Restore Purchases is available in the app for the Apple ID that bought Plus.
Plus unlocks more than one notebook and optional cloud features. We may change feature details, but we will not take away the paid unlocks for an active subscription term without a good operational or legal reason.
5. Acceptable use
You agree not to:
- Misuse the cloud service, probe it, or attempt to access other people’s accounts or data
- Use OnTheDaily to store or transmit content you do not have the right to store
- Reverse engineer the app except where the law allows
- Resell or sublicense the app
Journals are private. There is no public feed. You are still responsible for what you write.
6. Availability
The app and optional cloud service are provided as-is. Sync, sign-in, and App Store purchases can fail because of network, Apple, or Google outages. We do not promise uninterrupted service or that notes will never be lost.
7. Disclaimer and liability
To the fullest extent permitted by law, BrickByte Labs LLC disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. OnTheDaily is a consumer journal, not a medical, legal, or archival service.
To the fullest extent permitted by law, BrickByte’s total liability for any claim relating to OnTheDaily is limited to the amount you paid for Plus in the twelve months before the claim, or twenty US dollars, whichever is greater. Some places do not allow these limits; in those places, they apply only as far as the law allows.
8. Termination
You may stop using the app at any time. We may suspend cloud access if you materially breach these terms or if we must do so for security or legal reasons. Sections that should survive (including your content ownership, disclaimers, and liability limits) survive.
9. Apple
These terms are between you and BrickByte Labs LLC, not Apple. Apple has no obligation to provide maintenance or support for OnTheDaily. In the event of a failure to conform to an applicable warranty, you may notify Apple, and Apple may refund the App Store purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for our claims, product liability, legal or regulatory claims, or third-party IP claims arising from OnTheDaily. Apple is a third-party beneficiary of this section and may enforce it.
10. Changes
We may update these terms by posting a new version on this page. If you continue to use OnTheDaily after the effective date, you accept the update. If you do not agree, stop using the app and cancel Plus if you subscribe.
